Acceptance
By sending an enquiry, paying a booking amount, or attending a sitting, you accept these terms. If you are booking on behalf of a company, you confirm you have authority to bind it. If any part of an enquiry conflicts with a signed letter of engagement, the letter prevails for that booking.
The work
Utility Gardenhub provides professional reading of send logs, notification copy, and related counts. We do not sell software, hosting, or access to a product. Deliverables are those named in the quote: typically a written note, an annotated sample, and a sitting of stated length.
Your materials
Logs, screenshots, copy, and explanations you provide remain yours. You warrant that you have the right to share them with us for the review. You must not send us live production credentials. We may refuse or stop work if the materials are unlawful to hold or obviously obtained without authority.
Our materials
The findings note, tables we prepare, and margin comments are our intellectual property until the final invoice for that booking is paid; upon payment you receive a licence to use them inside your organisation, including with your usual advisors, but not to resell them as a product or to publish them as if they were your independent work without attribution. We may retain a copy as described in the privacy notice.
Fees and booking amounts
Fees are in Malaysian ringgit and are quoted for a defined window and scope. A booking amount of thirty percent holds a start week for an audit or briefing. Time spent waiting on an export is not billed as extra days unless we have agreed a standby arrangement in writing. Changes of scope (a second app, an older archive) are re-quoted before we read them.
Liability
We read the materials you supply. We do not guarantee a movement in opens, opt-outs, or revenue. Our aggregate liability arising from a booking is limited to the fees paid for that booking, except where Malaysian law forbids a limit (including death or personal injury caused by negligence, or fraud). We are not liable for indirect loss, including lost campaigns or board embarrassment, except as the law requires.
Confidentiality
We will not use your send copy or identifiable log excerpts in public examples without permission. Aggregated lessons that cannot identify you may appear in field notes.
Governing law
These terms are governed by the laws of Malaysia. The courts of Kuala Lumpur have exclusive jurisdiction, without prejudice to any non-excludable consumer rights.
